Application Provider

This application is published and operated by Florent PERILLAT-BOTTONET, a French sole proprietor registered in France under SIREN 879 769 578 (hereafter referred to as "the Publisher").

The Publisher provides the iOS mobile application "Studious" (the "App") to you, an individual user, subject to your acceptance of and compliance with these Terms of Service.

Agreement

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and Studious' Privacy Policy:

Privacy Policy

If you do not agree with these Terms or the Privacy Policy, you must not download or use the App.

This Agreement is made solely between you and Florent PERILLAT-BOTTONET. Apple Inc. is not a party to this Agreement and has no responsibility for the App or its content.

License Grant

The Publisher grants you a non-transferable, non-exclusive, revocable license to download and use the App on any Apple-branded device that you own or control, in accordance with these Terms and the Apple Media Services Terms and Conditions ("App Store Rules").

These Terms govern any content, materials, or services accessible through the App, as well as any future updates that replace or supplement the App.

You may not copy the App (except as permitted by this license and App Store Rules), reverse engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of the App or any part thereof.

Data Privacy

Your use of the App is governed by the Privacy Policy.

Disclaimer of Liability

To the maximum extent permitted by applicable law, the Publisher shall not be liable for any direct or indirect losses, damages, or legal consequences arising from your use of the App.

The Publisher does not guarantee uninterrupted access to the App and is not responsible for technical failures, bugs, crashes, errors, connectivity issues, or data loss.

By using the App, you agree to indemnify and hold harmless the Publisher from any claims, liabilities, losses, or expenses (including legal fees) arising from your use of the App or reliance on its content.

Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied.

The Publisher makes no guarantees regarding accuracy, reliability, performance, availability, or fitness for a particular purpose.

You acknowledge that use of the App is at your own risk.

In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligations.

Maintenance and Support

The Publisher is solely responsible for providing maintenance and support for the App.

You acknowledge that Apple has no obligation to provide maintenance or support services for the App.

Intellectual Property

All intellectual property rights in the App, including its name, logo, design, software code, and content, are owned exclusively by Florent PERILLAT-BOTTONET and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any part of the App without prior written consent.

By submitting feedback, suggestions, or other content, you grant the Publisher a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use such content in connection with the App and related business activities.

You acknowledge that Apple is not responsible for investigating, defending, settling, or discharging any third-party intellectual property claims.

Legal Compliance

You represent and warrant that you are not located in a country subject to a U.S. government embargo and that you are not listed on any U.S. government restricted or prohibited parties list.

Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.

Prohibited Uses

You agree not to attempt unauthorized access to the App or its systems, engage in hacking, malware distribution, or cyber attacks, decompile, decrypt, reverse engineer, or remove proprietary notices, or compromise the security or integrity of the App or other users.

Violations may result in suspension or termination of access and potential legal action.

Updates to the App and Terms

The Publisher reserves the right to modify or discontinue the App or any feature, and to update these Terms at any time.

Changes take effect upon publication within the App. Continued use of the App constitutes acceptance of the updated Terms.

Dispute Resolution

Any dispute arising from these Terms shall first be subject to mediation or arbitration where applicable.

You agree not to participate in class-action lawsuits.

These Terms are governed by French law, and any legal action shall fall under the exclusive jurisdiction of French courts.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Termination

This Agreement remains in effect until terminated by you or by the Publisher.

Your rights under this Agreement terminate automatically if you fail to comply with its terms.
